JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Khagaria (Gangaur) P.S. Case No.541 of 2015, disclosing offences under Sections 341, 323, 379 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel, appearing on behalf of the petitioner, states that there is a counter version of the occurrence said to have taken place on the same time and

He submits that the altercation had taken place between the parties after the informant had called the petitioner's wife a witch. He further submits that the petitioner has no criminal antecedent and is languishing in custody since 30.08.2015.

Considering the genesis of the occurrence and the submission made on behalf of the petitioner, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S. Case No.541 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
