JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1014 C of 2017 in which cognizance has been taken under Section 498A of the Indian Penal Code.

Allegation against the petitioner is of subjecting his wife to cruelty and torture with respect to demand of Rs.1.5 lakh.

Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and he is still ready to keep her with him.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, this application is disposed of with direction to

Patna High Court Cr.Misc. No.9206 of 2019(2) dt.19-02-2019 2/2 the petitioner to surrender within a period of six weeks from the receipt of this order along with a petition before the court below that he is ready to keep her with him and on filing of such petition he will be released on provisional bail for three months and in the meantime learned court below will issue notice to opposite party No.2 and on her appearance the court below will make an effort for reconciliation between the parties and after reconciliation if it is found that the petitioner is ready to take her to his house and if there is no fault on the part of the petitioner, his bail bond shall be confirmed, otherwise the court shall pass any other order(s) as it may deem fit and proper.
