JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Kadia (Balia Belon) PS Case No. 49 of 2015 for the alleged offences punishable under Sections 467, 468, 471, 420 and 414 of the Indian Penal Code.
The petitioner was arrested on 1.1.2015 for an offence punishable under Section 25(1-b)A/26 of the Arms Act. In course of search after his arrest, from his possession, a mobile phone was recovered. In course of enquiry, it was found that the SIM card was not duly verified. From his possession, a motorcycle was also recovered. With the allegation that the petitioner was using fake SIM card and stolen motor-cycle, the present case seems to have been instituted.
The petitioner is in custody since 30.4.2015 in
Patna High Court Cr.Misc. No.47574 of 2015 (2) dt.03-11-2015 2/2 connection with the present case after having been taken on remand.
In view of the nature of allegation, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balia Belon) PS Case No. 49 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
