JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-03-2022 Heard Mr. Awadhesh Kumar Mishra, learned Advocate for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Aayar P.S. Case No. 30 of 2020 dated 07.04.2020 instituted for the offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

On the exhortation of the parents of the petitioner, he and his brother are said to have assaulted the Informant. The mother of the petitioner has also filed a case against the Informant and another vide Aayar P.S. Case No. 31 of 2020.

The sister of the petitioner has received injuries in the aforesaid transaction.

Regard being had to the aforesaid background facts where the parties have fought against each other and both sides have received injuries, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Aayar P.S. Case No. 30 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
