====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Rupaspur P.S. Case No. 508 of 2019 for the offenses under Sections 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. In the instant case one desi khatta and cash was seized from the rented room and not from the conscious possession of the petitioner. The petitioner is in custody since 03.12.2019.

Considering the fact that the petitioner has no criminal antecedent and the alleged arms were not recovered from the conscious possession of the petitioner, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be

No.6763 of 2020(2) dt.04-02-2020 2/2 enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur, in connection with Rupaspur P.S. Case No. 508 of 2019.
