ANJANA MISHRA ORAL ORDER 3 04-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 376/ 302/201/34 of the Indian Penal Code.
Earlier, vide order dated 02.03.2015 passed in Cr. Misc. No. 24045 of 2014, the prayer for grant of bail of the petitioner was rejected by this Court.
A report had been called for with regard to the stage of trial of the present case in which it has been reported that the trial is in progress and two out of three witnesses have been examined. In fact, the trial Court is taking necessary steps so that the case may reach to its logical conclusion.
It is directed that the trial be concluded within a period of
Patna High Court Cr.Misc. No.47283 of 2015 (3) dt.04-11-2015 P2/2 nine months from the date of receipt/ production of a copy of this order.
This application is disposed of accordingly.
It is made clear that there shall no obstruction by the petitioner in the progress of the trial in this case. If the trial is not concluded within the aforementioned period, it shall be open to the petitioner to approach this Court for renewal of his prayer. (Anjana Mishra, J) Saif/- U T
