Case No. 81 of 2018 , disclosing offences under Section 30/30(a) of the Bihar Prohibition and Excise Act, 2016..

Allegation as per FIR is of recovery of 619 liters of foreign liquor from a pickup van and four persons were arrested and the petitioner is also named in the FIR along with other coaccused persons. Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession and the other co-accused persons have been granted privilege of bail by a Coordinate Bench of this Court vide order dated 03.05.2018 passed in Cr.Misc. No. 27036 of 2018 and vide order dated 03.07.2018 passed in Cr. Misc. No. 36396 of 2018.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge,2nd, Excise Act, Begusarai in connection with Teghra P.S. Case No. 81 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
