====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Muffasil P. S. Case No. 52/2021 in a case registered for the offences punishable under Sections 30(a), 32(3) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 138.120 liters illicit liquor was recovered from the poultry farm of this petitioner.

4. Learned counsel for the petitioner submits that No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims clean antecedent and he is in custody since 30.12.2024.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.10938 of 2025(2) dt.04-04-2025 2/2 bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1, Gaya in connection with Muffasil P. S. Case No. 52/2021.
