JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Magadh University PS Case No. 61 of 2014 for the alleged offences punishable under Sections 147, 149, 341, 323, 325, 302 and 504 of the Indian Penal code and Section 3(2)(V) of the SC and ST Act read with Section 4 of Prevention of Witch Practices Act.
Learned counsel for the petitioner, referring to the First Information Report submits that there is specific allegation of assault against Bhola Manjhi, Umesh Manjhi and Surendra Manjhi. So far as this petitioner is concerned, there is no specific allegation and similarly situated persons have been granted bail by this Court by order dated 20.7.2015 passed in Cr. Misc. No. 27051 of 2015.
Patna High Court Cr.Misc. No.47734 of 2015 (2) dt.09-11-2015 2/2 In view of the submission above, this application is allowed.
Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gaya in Magadh University PS Case No.61 of 2014.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
