The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 328 and 34 of the Indian Penal Code.
As per the prosecution case, it is stated by the informant that the five named accused persons including Vijay Kumar Mishra @ Mukhiya and the petitioner herein administered poison in liquor of the brother of the informant as a result of which he died after consuming the same. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. against the petitioner are false and concocted. From perusal of the F.I.R. itself, it would transpire that the main suspicion has been raised against Vijay Kumar Mishra @ Mukhiya with whom the deceased is
Patna High Court CR. MISC. No.19063 of 2021(4) dt.15-11-2021 2/2 said to have political rivalry. The petitioner has no cause to give effect to the occurrence. The petitioner is in custody since 5.9.2020 and investigation in the case has concluded. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year 2 months, the Court directs the petitioner to be enlarged on bail in connection with Ghanshyampur P.S. Case no.222 of 2020(G.R. no.748 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIII, Biraul, District Darbhanga.
