Heard learned counsel for the petitioners and learned
Patna High Court Cr.Misc. No.45514 of 2014 (2) dt.30-01-2015 2/3 A.P.P. for the State.
Allegation against the petitioners is to have assaulted the informant and when his mother Lalita Devi came to rescue him, all the accused including the petitioners assaulted her which caused her injury. She fell down and became senseless and ultimately died. Further allegation is that they have also assaulted the father and younger brother of the informant. It is submitted that both informant Shrawn Ram and accused Prem Chandra Ram were in intoxicated condition and they were quarelling. The mother of the informant came to pacify them and thereafter the occurrence of assault has taken place between both the parties. Munna Kunwar, mother of Prem Chand has also lodged Buxar (M) P. S. Case No. 182 of 2014 for the same occurrence.
After investigation charge-sheet has already been submitted and there is no chance of tampering with the evidence. The petitioners have no criminal antecedent. Considering the facts and circumstances, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar /court concerned in Buxar (M) P. S. Case No.
Patna High Court Cr.Misc. No.45514 of 2014 (2) dt.30-01-2015 3/3 conditions:-
1. The petitioners will not indulge themselves in similar or any other offence.
2. One of the bailors must be the close relative of the petitioners.
3. The petitioners will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, their bail bonds would be liable to be cancelled by the learned Court concerned.
