Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 186, 188, 323, 353, 337, 504 and 506 of the Indian Penal Code, registered in connection with Khiri More P.S.Case No. 94 of 2021. As per allegation, the accused persons including the petitioner created chaos at the time of counting of votes of Mukhiya election. The accused persons also pelted stones etc. and some police personnel got injured.

No.8346 of 2022(2) dt.01-09-2022 2/2 The learned counsel for the petitioner has submitted that some malpractices were done at the instance of the informant in counting of votes and in this respect the wife of the petitioner Meena Devi firstly filed CWJC No. 18781 of 2021 and thereafter she filed an election petition. He has submitted further that the petitioner is a person of clean antecedent. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Danapur in connection with Khiri More P.S.Case No. 94 of 2021, subject to the conditions as laid down under Section 438(2) Cr.e P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
