The petitioner is languishing in custody for the offences punishable under Sections 304B/201/34 of the Indian Penal Code.

Submission of the learned counsel for the petitioner is that wife of this petitioner died within a year of marriage due to kidney failure, which would be evident from the prescription and pathological report Annexed with the bail petition. After her death just to pressurize this false case was lodged with allegation of demand of dowry and torture for the same. Considering the conflicting material on the record, let the petitioner, above named, who is in custody since 29.07.2018

Patna High Court CR. MISC. No.9779 of 2019(3) dt.30-04-2019 2/2 be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Belaganj P.S. Case No.79 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
