2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201/34 of the Indian Penal Code.
3. The prosecution case as per FIR is that on 21.8.2020 the accused persons along with the petitioner assaulted the informant's daughter with deadly weapons and killed her into pieces.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The deceased was married to co-accused Sudhir Yadav. This petitioner is nephew of the deceased and he has no concern with her. There is no specific
Patna High Court CR. MISC. No.13437 of 2024(4) dt.15-05-2024 2/2 overt-act against this petitioner. Similarly situated co-accused Subhash Yadav has already been enlarged on bail by this Court vide order dt. 18.9.2023 passed in Cr. Misc. No. 218 of 2020. The petitioner has got no criminal antecedent and languishing in judicial custody since 31.7.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barari P.S. Case No. 218 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Katihar.
