JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 06-06-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 356 and 382 of the Indian Penal Code in connection with Patori P.S. Case No. 466 of 2021.

The crux of the accusation as set out in the FIR against the petitioner that the looted mobile was recovered from his possession.

Accused/petitioner is not named in the FIR and in custody since 15.12.2021.

Learned counsel for the petitioner submits that the petitioner is an innocent person, for the reason that at the time of purchasing of the alleged looted mobile, the occurrence was not

He further submits that the petitioner is involved in other 04 similar cases, in which, the petitioner implicated after lodging the present case. While arguing over the matter, it has further been submitted that the charge-sheet has already been submitted in this case, as such, there is no chance of tampering with the evidence.

Learned APP appearing on behalf of the State, while opposing the prayer for bail fairly conceded that charge-sheet has been submitted in this case.

Considering the facts and submissions as made above and as charge-sheet has been submitted in the case, let the petitioner, above named, is directed to be released on bail in connection with Patori P.S. Case No. 466 of 2021 on furnishing bail bound of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JM-1st Class, Samastipur, subject to the following conditions: "(1) That the petitioner shall not be involved in the similar nature of case till conclusion of the trial and learned court below shall be at liberty to cancel the bail bond of the petitioner, if the involvement of the petitioner will be found in the similar
