====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Madhepura (Parmanandpur) P.S. Case 876 of 2018, instituted for the offence under Section(s) 363, 365, 120(B)/34, 302 and 201 of the Indian Penal Code.

It is alleged in the written report that husband of the informant had gone with co-accused Sudhir Yadav by Motorcycle on pretext of payment of due amount. Later on, the husband of the informant was found dead. The informant enquired from Sudhir Yadav about her husband but he did not give any reply and misbehaved with her.

Counsel for the petitioner submits that there is no allegation of any specific overt act against petitioner. Petitioner

Patna High Court Cr.Misc. No.8436 of 2019(2) dt.13-02-2019 2/2 has been made accused because he is father of Sudhir Yadav. Petitioner is in custody since 26.10.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura (Parmanandpur) P.S. Case 876 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
