The petitioner apprehends his arrest in Rosera P.S. Case No.268 of 2020, registered for the offences punishable under Sections 323, 341, 353, 379, 385, 427, 448, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that the occurrence took place on 29.08.2020, the FIR was lodged on 30.08.2020 and the same was sent to the concerned court on 01.09.2020. It is submitted that the FIR was sent to the court after delay of two days. It is further submitted that the petitioner is a Ward Councilor and he always protested

Patna High Court CR. MISC. No.12734 of 2021(2) dt.03-12-2021 2/2 against the functioning of the informant in the interest of local people due to which the petitioner is made accused in the present case. It is also submitted that the petitioner has got no criminal antecedent as stated in para 3 of the bail petition. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera at Samastipur in connection with Rosera P.S. Case No.268 of 2020, subject to the conditions laid down under Section 438(2) Cr.P.C. (Anjani Kumar Sharan, J.) Sanjay/- U T
