The petitioners have preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the F.I.R., 261 litres of liquor was recovered from the vehicle in which the two petitioners were travelling and both the petitioners were taken into custody. It is submitted by learned counsel for the petitioners that the petitioners have been falsely implicated in the case. No incriminating article has been recovered from their

Patna High Court CR. MISC. No.19073 of 2021(2) dt.02-09-2021 2/2 possession or vehicle. They are in custody since 18.9.2020 and have no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the petitioners not having any criminal antecedent, the Court directs the petitioners to be enlarged on bail in connection with Jhanjharpur P.S. Case no.184 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd-cumSpecial Judge, Excise Act, District Madhubani.
