JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 328, 302, 379 and 120B/34 of the Indian Penal Code. Allegation against the petitioner is that he has been made accused in a case of road accident where a dead body was found in the scattered condition.

It has been submitted on behalf of the petitioner that he is in custody since 1.10.2014. Chargesheet has been submitted in the case against the petitioner. There is no allegation of tampering with the evidence against the petitioner. Petitioner is the driver of the vehicle. Petitioner has been made accused on the basis of confessional statement of the co-accused. Except that there is no other material against him. The other co-accused has been granted bail vide Cr. Misc. no. 4680 of 2015.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

No.23067 of 2015 (4) dt.07-10-2015 2 / 2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sherghati, Gaya, in connection with Barachatti P.S. Case no. 458 of 2014.
