2. The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 103(1) r/w 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per allegation in the FIR, informant's sister (deceased) was married to co-accused Arvind Kumar in the year 2017. It is alleged that petitioner in collusion with co-accused persons, who are his family members, have committed murder of informant's sister.
4. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.10408 of 2025(3) dt.12-05-2025 2/3 petitioner is that petitioner is innocent and he has been falsely implicated in this case. Petitioner is brother-in-law (Dewar) of the deceased and there is no specific allegation against him rather the allegation levelled against him is general and omnibus. It is further submitted that petitioner has no concern in any way to the alleged occurrence and he is 60% visually disabled (Form III issued by Sadar Hospital, Buxar is annexed). After completion of investigation, charge-sheet has been submitted in this case. Moreover, petitioner is in judicial custody since 03.10.2024.

Learned APP appearing on behalf of the State as well as learned counsel for the informant has vehemently opposed the prayer of the petitioner and submitted that from perusal of para 14, 62 and 63 of the case diary, it is evident that witnesses (Gajendra Singh, Vakil Singh and Kashinath Singh) have supported the prosecution version of the case. Inquest report has been annexed in para 2 of the case diary, from perusal of which
Patna High Court CR. MISC. No.10408 of 2025(3) dt.12-05-2025 3/3 it appears that antemortem injury was found. Cause of death as mentioned in postmortem report is in para 40 of the Case Diary. As per Postmortem report, cause of death is mentioned as Cardio Pulmonary failure due to shock and hemorrhage following head injury caused by hard and blunt object.
6. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
