The petitioner is languishing in custody since 23.12.2018 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that the petitioner was found with country made liquor on a boat, leading to recovery of 360 litres of illicit country made liquor.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the alleged recovered liquor rather he was forced by someone to load the liquor on boat in question. A statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.9066 of 2019(2) dt.15-02-2019 2/2 petitioner is not having any criminal antecedent. Learned APP submits that the petitioner was found loading liquor on the boat.

Considering the period under custody coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 12095 of 2018, arising out of Khajekalan P.S.
