JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-04-2023 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Vidyapati Nagar P.S. Case No. 26 of 2020 registered for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 354, 379, 307, 504 the Indian Penal Code. Petitioners are said to have assaulted the informant and his mother by means of farsa and iron rod causing head injury to the informant and his mother.

Learned counsel for the petitioner submitted that petitioners have falsely been implicated in this case. Allegation against the petitioners are that they assaulted the informant and

It is further submitted that there is case and counter case between the parties and both sides sustained injuries and there is admitted land dispute. It is further submitted that petitioner has clean antecedent as stated in para-3 of this application. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Judicial Magistrate, 1st class, Dalsingsarai in Vidyapati Nagar P.S. Case No. 26 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
