JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-09-2022 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of writ in the nature of mandamus restraining the respondent authorities from construction of a public road upon the raiyati/ purchased land of the petitioner to acquisition of the land that too after payment of fair compensation or with the consent of the petitioner as respondent authorities are constructing the public road upon Plot No. 185, 192 of Khata No.107, 121 respectively

Patna High Court CWJC No.8065 of 2021(2) dt.22-09-2022 2/2 and Plot No. 316, 318, 315, 220 which are either ancestral land or purchased of the petitioner. (ii) For further direction to the respondent authorities to adhere to the agreement arrived between concern Mukhiya and other villagers on 26.09.2016 whereby concern Mukhiya has given undertaking not construct the public road and on the basis of this agreement petitioner has withdrawn the earlier writ application from this Hon'ble Court." At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Jamui, for redressal of his aforesaid grievance. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the District Magistrate, Jamui, by filing appropriate representation within a period of four weeks from today, the District Magistrate, Jamui shall take a decision thereon, in accordance with law, within a period of 12 weeks, thereafter. The writ petition stands disposed off on the aforesaid terms.
