JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 The petitioner seeks regular bail in connection with Buxar (Town) P.S. Case No. 748 of 2019, registered for offences punishable under Sections 147, 148, 149, 448, 307 and 120(B)of the Indian Penal Code and Section 27 of the Arms Act. Prosecution case is that the petitioner and several other accused persons came in a group on the land of the Informant variously armed and made indiscriminate firing causing death of one person and injuries to three persons. Apart from that the petitioner is accused in one other case. Submission of learned counsel for the petitioner is that occurrence took place with respect to the land dispute between the parties. There is a counter-case also in which several persons have received injuries. No specific allegation

Patna High Court CR. MISC. No.7067 of 2020(3) dt.27-02-2020 2/2 has been attributed against him. Further, the petitioner has been in judicial custody since 22.10.2019 and charge-sheet has been submitted, therefore, there is no chance of tampering with the evidence.

Heard learned A.P.P. as well as the Informant who has opposed the prayer for bail.

It has been submitted on behalf of the Informant that the petitioner along with other co-accused has came to grab the land and there is land dispute between the Informant and one other co-accused person who has called them as hired criminal. Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 748 of 2019.
