The petitioner is accused in connection with Belaganj P.S. Case No. 74 of 2015 registered under Section 376 of the Indian Penal Code and Section 6 of the POCSO Act. The informant, Renu Devi, made allegation against the petitioner to commit rape to her minor daughter, Rajni Kumari, aged about 12 years. Again on 02.05.2015, in absence of informant, petitioner attempted to commit rape with the daughter of informant. On 13.05.2015, panchayati was made but petitioner and his family members disobeyed the order of Panchayat. Learned counsel for the petitioner submits that allegation of rape with daughter of informant has been made
Patna High Court Cr.Misc. No.26597 of 2015 (3) dt.07-10-2015 against the petitioner but the victim denied in her statement, under Section 164 Cr.P.C., to commit rape by the petitioner, in fact, petitioner is cousin of the victim and due to misconception this false case has been lodged. It is further submitted that petitioner has not criminal antecedent and is in custody since 14.05.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge-(POCSO Act), Gaya, in connection with POCSO Case No. 35 of 2015 arising out of Belganj P.S. Case No. 74 of 2015.
