The petitioner seeks regular bail in connection with Kasba P.S. Case No. 323 of 2018 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(A), 38(i), 38(ii), 41(i) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding recovery of 49.50 litres of illicit liquor from a tempo.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. It is further submitted that the petitioner is only the driver of the tempo, hence the recovery of illicit liquor cannot be attributed to the
Patna High Court Cr.Misc. No.8970 of 2019(2) dt.15-02-2019 2/2 petitioner herein. Lastly, it is submitted that the petitioner is languishing in custody since 13.12.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cumSpecial Judge (Excise Act), Purnea in connection with Kasba P.S.
