JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04.08.2021 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

The learned counsel for the petitioner, in presence of the learned APP for the State, Shri Ashok Kumar, seeks to withdraw the present petition which has been filed for grant of regular bail in connection with Turkaulia (Raghunathpur) P.S. Case No. 437 of 2017, for the offence punishable under sections 302 and 34 of the Indian Penal Code, with liberty to renew his prayer for bail after one year in case the trial of the case is not completed.

At this juncture, the learned counsel for the petitioner has pointed out that the learned court below has not yet even

framed the charges. In such view of the matter, the learned court below is directed to frame the charge forthwith and expedite the trial of the case.

The present petition stands disposed of as not pressed, however, with the aforesaid liberty to the petitioner and directions to the Ld. Court below.
