JUSTICE SUDHIR SINGH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner no.2 (Qaiyum Khan) and learned A.P.P. for the State.
The petitioner no.2 is in custody in a case registered under Sections 307 and other allied Sections of the Indian Penal Code.
The allegation against the petitioner no.2 is that he assaulted the brother (Zahid Babu) of the informant with lathi on his head resulting head broken.
It has been submitted on behalf of the petitioner no.2 that he is in custody since 16.6.2015. Charge sheet has been submitted in this case. It has been further submitted on behalf of the petitioner no.2 that he has been falsely implicated in the present case due to enmity between the parties. It is a case and
Patna High Court Cr.Misc. No.37066 of 2015 (3) dt.07-10-2015 2/2 counter case between the parties and the petitioner no.2 is a bona fide purchaser of the land. It is also submitted that the petitioner no.2 may be released after completion of six months in custody from 16.6.2015.
On behalf of the State, it has been submitted that the injuries caused on the informant side are grievous in nature. Considering the facts aforesaid, let above named petitioner no.2, after completion of six months of custody from 16.6.2015, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, learned J.M., 1st Clsass,Araria in Palasi P.S.Case No. 107 of 2015.
