JUSTICE AMARESH KUMAR LAL ORAL ORDER 11-03-2015 This application has been filed for grant of bail in Sessions Trial no. 131/98/151/2013 arising out of Kurtha P. S. Case no. 54 of 1994 for the offence punishable under Sections 302, 436, and 429/149 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted that the petitioner was granted bail on 29.3.2000 and he remained on bail till 29.8.2006 and thereafter his bail bond was cancelled. It is further submitted that the petitioner had gone out of State for his livelihood and due to non-appearance his bail bond was cancelled. Now the petitioner has been in custody since 7.12.2013 and it appears from the report of the learned trial court that the trial is not likely to be concluded in near future. The petitioner has already suffered for his absence in the trial court.
Considering the facts and circumstances, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two genuine sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-III, Jehanabad, in Kurtha P. S. Case no. 54 of 1994
Patna High Court Cr.Misc. No.49337 of 2014 (4) dt.11-03-2015 2/2 with the following conditions :-
1. The petitioner will not indulge in similar or in any other offence.
2.
The petitioner will be well represented in the court.
3. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J) sudip/- U T
