JUSTICE RAJIV ROY ORAL ORDER 19-06-2023 Heard learned counsel for the petitioners and the State as also the Zila Parishad, Rohtas, Sasaram. Good sense have prevailed upon the parties and they have come to a consensus that :
(i) the petitioners shall be clearing all the existing dues @ Rs. 1,000/- till May, 2023 and a demand draft in favour of the Zila Parishad, Rohtas, Sasaram shall be individually submitted by them;
(ii) each individual shall be filing separate application for renewal of his/her shop and the same shall be considered positively.
Taking into account the fact they are in the possession
11/11 of the said shops since 1983 and as per the learned counsel for the petitioner, they are ready to pay the rent fixed by the rent controller, the Zila Parishad, Rohtas, Sasaram shall consider their respective applications for the renewal positively. The aforesaid exercise shall be completed within a period of four weeks from the submission of the application preferred by each and every individual.
In case, any of the application is bereft of the demand draft showing payment of rent till May, 2023, the Zila Parishad, Rohtas, Sasaram will have the option of rejecting the said application.
This order has been passed taking into account the submission of the learned counsel for the petitioners that they are still in possession of the shops which was not denied by the learned counsel representing the Zila Parishad, Sasaram. With the aforesaid observations, all the three writ petitions stands disposed of.
