====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Learned counsel for the petitioner submits that earlier by order dated 04.01.2023 in Cr. Misc. No. 54264 of 2022, the prayer for bail of the petitioner was rejected. However, the petitioner was granted liberty to renew his prayer for bail after framing of the charge.

Learned counsel for the petitioner draws the attention of the Court to Annexure-3 and submits that the charges have been framed against the petitioner by order dated 08.09.2022. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the submission and the fact that charges

Patna High Court CR. MISC. No.12404 of 2023(2) dt.29-03-2023 2/2 against the petitioner have been framed, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonepur (Hajipur) P.S. Case No. 135 of 2022.

However, in the event if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall forthwith cancel the bail bonds of the petitioner after recording reasons and will take all coercive steps to ensure that the petitioner is put behind the bar.
