The petitioner seeks bail in a case registered for the offence under Section 304(B)/34 of the Indian Penal Code. It is a case of dowry death and petitioner happens to be father-in-law of the deceased.

It is submitted on behalf of petitioner that thrust of the accusation is against husband of the deceased, who is already in custody. There is general and omnibus allegation. Petitioner is separate in mess and property and has got no concern with the family affairs of deceased and her husband. Petitioner is in custody since 06.07.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the

Patna High Court CR. MISC. No.8818 of 2022(2) dt.12-04-2022 2/2 bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XV, Gaya in connection with S.Tr.No. 338 of 2021, arising out of Sherghati P.S. Case No. 439 of 2021.
