JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Khagaria (Mufassil) P.S. Case No. 133 of 2015 registered under Sections 35(1-A)B, 26 and 35 of the Arms Act. The accusation is of recovery of one loaded country made pistol along with one loaded country made rifel from possession of petitioner no. 2 and one loaded country made rifel from possession of petitioner no.1.

Learned counsel for the petitioners submits that seizure list witnesses are the police official which shows about the

Patna High Court Cr.Misc. No.26938 of 2015 (3) dt.07-10-2015 false implication against the petitioners showing the recovery of alleged arms. It is further submitted that petitioners have no criminal antecedent and are in custody since 05.03.2015. Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Mufassil) P.S. Case No. 133 of 2015. Out of two sureties, one surety must be the close relative of the petitioners, who will file an affidavit showing his relation with the petitioners.
