JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 04-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Informant, Reshmi Devi while was returning and reached near the shop of petitioner, Dilip Nutt @ Benga, it has been alleged that she has been caught hold by the petitioner and further, dragged towards his shop with ulterior motive, which was resisted and during course of scuffle, he torn her blouse. During midst thereof, her husband arrived, who was also assaulted by the petitioner with knife causing injury over finger. It has been submitted on behalf of petitioner that when the petitioner raised demand over the persisting dues, on account thereof, instant case has been registered. Petitioner happens to be under custody since 16.08.2015, having no criminal antecedent.

Patna High Court Cr.Misc. No.48968 of 2015 (02) dt.04-11-2015 On the other hand, learned Additional Public Prosecutor opposed the prayer.

In the aforesaid facts and circumstances of the case, petitioner, Dilip Nutt @ Benga is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Mr. Jigar Sah, Judicial Magistrate, 1st Class, Gaya in connection with Tekari P. S. Case no.327 of 2015.
