The petitioner is languishing in custody since 15.10.2018 in a case registered for the offences punishable under Sections 419,420,467,468,471,489B and 489C/34 of the I.P.C. The prosecution case is that from the possession of the petitioner, five fake currency notes of Rs.100/- denomination each were recovered.
It is submitted by learned counsel for the petitioner that the accusation has been levelled merely on the basis of suspicion. It is further submitted that the petitioner got the alleged fake currency notes from someone in day-to-day transaction. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.
Learned APP submitted that recovery of fake currency
Patna High Court Cr.Misc. No.11040 of 2019(2) dt.25-02-2019 2/2 notes as been made from the petitioner.
Considering the fact that verification of recovered fake currency has not been made by the expert agency, the investigation has already been concluded, statement being made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, coupled with the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-10, Saran at Chapra in connection with Rasulpur P.S. Case No.128 of 2018.
