JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Mahila P.S. Case No. 41 of 2019, registered for offences punishable under Sections 376 of the Indian Penal Code and Section 4 of the POCSO Act.

Allegation against the petitioner is of ravishing the minor girl, who is informant in the present case and doctor has also assessed her age as 14 to 15 years.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and te medical report does not support the prosecution case and he has been in custody since 02.11.2019.

Learned counsel for the State opposed the prayer for bail on the ground that there is direct allegation against the petitioner supported by the statement of the victim girl recorded

Patna High Court CR. MISC. No.6759 of 2020(3) dt.28-02-2020 2/2 under Section 164 Cr.P.C. and the victim girl is also minor. Having heard both sides, in view of the nature of allegation, I am not inclined to enlarge the petitioner on bail. This application is accordingly dismissed.
