The petitioner is in custody in a case registered under Section 394 of the Indian Penal Code.

The allegation against the petitioner and other coaccused is that they have assaulted the informant on his head with a sharpen iron rod causing injury on the head. It is further alleged that the petitioner took out Rs. 5,000/- from the pocket of the informant and Rs. 3000/- from the pocket of Nishat. It has been submitted on behalf of the petitioner that the petitioner is in custody since 2.5.2015.Charge sheet has been submitted in this case. The petitioner has been made accused in this case due to mistake of fact. The allegation against the

Further, it has been submitted on behalf of the petitioner that the petitioner is ready to deposit an amount of Rs. 5,000/- in the court below, which shall be subject to final disposal of the case.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, the petitioner is directed to deposit an amount of Rs. 5,000/- in the court below, which shall be subject to final disposal of the case.

Let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M., 1st Class, Sikrahana at Motihari, East Champaran at Motihari in Chiraiya P.S.Case No. 76 of 2015.
