JUSTICE MUNGESHWAR SAHOO ORAL ORDER 27-02-2015 The petitioner, namely, Vikrama Singh is in custody since 27.06.2014 in Piro P.S. Case No.187 of 2014 under Sections 147, 148, 149, 323, 341, 307, 302, 120-B of the Indian Penal Code and 27 of the Arms Act.

According to the prosecution case, the co-accused persons, namely, Prem Prakash @ Chintu Singh, Raju Singh, Rajesh Singh, Dhiran Singh, Hari Charan Singh, Binay Singh @ Jhunnu Singh, Satyendra Singh, Dhananjay Kumar @ Chhotu Singh with deadly weapons, i.e. pistol, katta etc. started indiscriminating firing on Manoj Kumar Yadav, Tej Narayan Singh, Sri Ram Singh and Vikash Kumar. Anyhow the other three persons fled away but Manoj Kumar, son of the informant fell down because of injury and died. The informant alleged that in this killing process this petitioner and other named co-accused had

Patna High Court Cr.Misc. No.46849 of 2014 (2) dt.27-02-2015 conspired.

From perusal of the F.I.R., it appears that only allegation against the petitioner is that he conspired with the named accused persons against whom there is allegation of indiscriminating firing.

Considering the nature of allegation and the period in detention I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Piro P.S. Case No.187 of 2014.
