JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and the State. The grievance of the petitioner in the instant case is against the posting as In-charge Headmaster in the school in upgraded Middle School Mohammadpur Jumman Fathepur, Vaishali Considering the fact that there is no regular headmaster and as such, for posting of In-charge Headmaster in the school in question as per their seniority, the competence of the petitioner or the respondent for posting is the only dispute in

Patna High Court CWJC No.18490 of 2017 (2) dt.20-12-2017 2/2 question.

Without going into the controversy as to the seniority and entitlement to be posted as In-charge headmaster, the writ petition is disposed of with direction to the respondent, the District Programme Officer (establishment) respondent no.5 to take steps for posting of regular In-charge headmaster in the school in question positively within a period of 30 days from the date of receipt/production of a copy of this order, failing which neither the petitioner nor the respondent no.7 shall function as In-charge Headmaster in the school in question.

With the aforesaid, the writ petition stands disposed of.
