In this case, the petitioner is seeking bail in connection with Khaira P.S. Case No. 179 of 2015 registered for offences under sections 147, 148, 149, 341, 323, 307 and 504 of the Indian Penal Code.

It appears that from both sides there is free fight and there is a specific allegation against the petitioner to have assaulted the victim by Farsa which caused grievous injury to the victim.

The counsel for the petitioner submits that the petitioner is in custody since 5th September 2015. Looking to the period of custody and the nature of

Patna High Court Cr.Misc. No.51259 of 2015 (2) dt.30-01-2016 2/2 allegation made against the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition is dismissed. However, liberty is given to the petitioner to renew his prayer for bail after eight months of custody.
