In course of arguments, considering the nature of the dispute involved in this case, learned counsel for the petitioner as well as the respondent - Bank and the auction purchaser agree that the dispute may be allowed to be examined and a decision be taken by the Debts Recovery Tribunal, Patna in terms of the direction contained in paragraph '23' of the appellate order as contained in Annexure '18' to the writ application.
