The petitioner seeks bail in S.T. No.208 of 2018 arising out of Parbattha (Maraiya) P.S. case No.418 of 2017 registered under Sections 285, 307, 326, 498(A)/34, 302 of the Indian Penal Code, pending in the court of Sessions Judge, Khagaria.
The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner is the husband of the deceased and the F.I.R. is dying declaration of the deceased. A report was called for from the court below regarding the stage of trial. It has been reported that the charge has been framed and the trial is expected to be concluded within
Patna High Court CR. MISC. No.10881 of 2019(3) dt.03-07-2019 2/2 a period of three months.
Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.
The Trial Court is directed to take all necessary steps to conclude the trial preferably within a period of three months from the date of receipt/production of a copy of this order. The District Magistrate, Khagaria and the Superintendent of Police, Khagaria are also directed to take necessary steps to produce the witnesses on the date fixed by the Trial Court so that the trial could be concluded within the stipulated period.
Let this order be communicated to the District Magistrate, Khagaria and the Superintendent of Police, Khagaria.
