The petitioners seek regular bail in connection with Nasriganj (Rajpur) P.S. Case No. 191 of 2017 for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
The allegation in the present case is regarding the school in question having received subsidy amount to the tune of Rs.6,58,400 from the Bihar School Examination Board, Patna for the financial year 2007-08 and 2010-11, however, the same was misappropriated by the Headmaster of Smt. Rajdulari Sondrik Girl High School, Rajpur, who is the petitioner no.1.

The learned senior counsel appearing for the petitioners submits that some amount out of the said subsidy of Rs. 6,58,400/- has been distributed to the teachers by cheque and rest of the amount is lying in the account of the school maintained in the Bank, however, alternatively, it is submitted that in case the petitioners are released on regular bail, they can participate in the investigation and prove their innocence, therefore, the petitioners are ready to deposit 50% of the aforesaid amount as a security deposit, subject to the result of the present case. It is further submitted that the petitioner no.1 is languishing in custody since 23.11.2018 and as far as petitioner no.2 is concerned, he is languishing in custody since 24.11.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioners, above named, on regular bail subject to deposit of a sum of Rs. 3.25 lacs with the learned trial court and further subject to such conditions as may be imposed by the learned court of S.D.J.M., Bikramganj, Rohtas in connection with Nasriganj (Rajpur) P.S. Case No.191 of 2017.
