For the Petitioner/s : Mr Ashutosh Ranjan Pandey For the Opposite Party/s : Mr Abhay Kumar No. 1 (APP) ====================================================== CORAM: HON'BLE MR JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-02-2015 Petitioner is in custody in relation to Narhat (Sitamarhi) Police Station (PS) Case No 130 of 2014 instituted under Sections 376/511 of Indian Penal Code read with Sections 6 and 18 of the Protection of Children from Sexual Offences (POCSO) Act, 2012. The petitioner is in custody since 09.08.2014 and it is alleged that petitioner had forcefully carried seven years old sister of the informant to his house and locked her up in a room and when the mother of the girl went looking her, she heard cries from inside the room which she opened and saw allegedly the petitioner trying to rape the victim and beating her. Learned counsel for the petitioner states that in the case diary, in paragraphs 32, 33, 34, it has come to light that in fact the petitioner used to lend money and when he had gone to ask for

Patna High Court Cr.Misc. No.46182 of 2014 (3) dt.11-02-2015 repayment thereof, the dispute arose and hence this false implication. No such incident had taken place. Be that as it may, the petitioner abovenamed shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge -cum- Additional Sessions Judge I, Nawada in POCSO Case No 10 of 2014 arising out of Narhat (Sitamarhi) PS Case No 130 of 2014.
