JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 The learned counsel for the petitioner is permitted to make necessary correction in Para-1 and prayer portion of the bail application during course of the day.

Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with C2 Case No.560 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 06.12.2021, prosecution report has been submitted in the case and has antecedent of one case. Allegation is of recovery of 150 litre of liquor from an auto.

Patna High Court CR. MISC. No.8301 of 2022(2) dt.09-03-2022 2/2 The learned counsel for the petitioner submits that petitioner is the driver of the auto and as such, was not knowing which passenger had kept the liquor in the auto. The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, prosecution report has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Special Excise Court-II, Sitamarhi in connection with C2 Case No.560 of 2021. The application stands allowed.
