Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 467, 468 of the I.P.C. and section 30 (a)/ 32(i) (ii)/ 36/ 46 (I) of the Bihar Prohibition & Excise Act 2016-18.
Prosecution case is that 681.480 liters of country made foreign liquor has been recovered from two different vehicles.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner nor driver of the vehicle. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way
Patna High Court CR. MISC. No.9264 of 2023(3) dt.01-05-2023 2/2 connected with the aforesaid recovery. Petitioner has not got criminal antecedent of similar nature.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur in connection with Kanti Police Station Case No. 510 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
