JUSTICE RAVI RANJAN ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the Special P.P. for the State.

The petitioner seeks bail in a case registered for offences punishable under Sections 406, 417, 420, 504, 506 of the Indian Penal Code and Section 3 (i) (x) of SC/ST (Prevention of Atrocities) Act.

As per the allegation, the petitioner had taken money from the informant and others for the purpose of giving benefit under the different schemes and when the same was not done, they asked about the same, upon which, the petitioner misbehaved with them using abusive language taking name of their caste. It is submitted on behalf of the petitioner that the petitioner is running a grocery shop and the informant and others

Patna High Court Cr.Misc. No.50190 of 2015 (2) dt.10-11-2015 2/2 had taken articles from his shop on credit and when the petitioner demanded back the money then he has been falsely implicated in this case. It is further submitted that the petitioner is in custody since 26.08.2015 having no criminal antecedent. Considering the facts and circumstances of the case, the petitioner, namely, Ranjeet Kumar @ Gabbar Lal @ Gabbar is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Nawada in Nawada SC/ST P.S. Case No.26 of 2014 with a further condition that one of the bailors must be a close relative or family member of the petitioner who shall file affidavit before the concerned court giving complete genealogy to show his/her relationship with him.
