The grievance of the petitioner, in this writ petition, is that his father was a pensioner bearing PPO No. 169713 issued on 07.11.1991. The father of the petitioner was retired from the post of Teacher. The father of the petitioner received pension till August, 2004 but thereafter his father settled down with his sons and daughters and no pension was credited in his account. The respondent No.2, the Senior Treasury Officer, Gaya filed counter affidavit stating therein that petitioner did not ever file any petition before the Treasury Officer or the Bank about the death of his father and mother of the petitioner. Even the life certificate was not deposited in the bank. Once the petitioner submits the entire documents of pension and family pension, the arrears of pension and family pension can be released. The Treasury Officer issued letter to the petitioner on 29.01.2019 vide letter No. 109 directing him to submit the relevant papers. The learned counsel for the petitioner informs

Patna High Court CWJC No.18630 of 2017(3) dt.28-05-2020 2/2 that petitioner has already submitted the entire papers before the competent authority but till date no order is passed. From the facts, it is evident that pension was not paid after the year 2004. It appears that father of the petitioner never filed any life certificate in the bank, which was required to be filed at the end of the year in the bank and, therefore, the pension amount was not credited.

Having considered the facts, the petitioner is directed to file petition with all the relevant papers before the Treasury Officer as well as before the bank from where the father of the petitioner was drawing pension for grant of family pension as well as for payment of arrears of pension and family pension of his father and mother and thereafter the concerned authority shall dispose of the petition of the petitioner within four months from the date of receipt of such petition.

With the aforesaid direction, this writ petition is disposed of.
