JUSTICE RAKESH KUMAR ORAL ORDER 18-12-2015 Heard Sri Basant Kumar Singh, learned counsel, who was assisted by Sri Deovind Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 06.02.2014 in connection with Chutia P.S. Case no.09/2011 registered for the offence under Sections 147,148,149, 379, 504 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner was not named as accused in the F.I.R. However, subsequently the son of the informant has disclosed the name of the petitioner and during investigation, one of the accused also disclosed the name of the petitioner He submits that the

Patna High Court Cr.Misc. No.55417 of 2015 (2) dt.18-12-2015 2/2 petitioner is in custody since 06.02.2014. Accordingly, he has prayed for grant of bail.

On perusal of paragraph-3 of the petition, it is evident that the petitioner is a habitual offender.

Keeping in view the criminal antecedent of the petitioner, I am not inclined to grant bail to the petitioner. The petition stands dismissed.
