2. The present petition has been preferred for the following relief(s):

"(i) For issuance of a writ in the nature of Mandamus directing and commanding the respondent to pay the compensation of the petitioner's land bearing Khata no. 149 Plot no.84 Area 0.554 which is situated at Basti Jalal P.S. Dighwara in the district of Saran at Chapra.

Patna High Court CWJC No.17075 of 2016(2) dt.18-08-2025 2/3 (ii) For issuance of a writ in the nature of mandamus directing and commanding the respondent measurement acquired land of the petitioner and respondent no.6 and thereafter pay their compensation Commercial rate as per notification by the District Land Acquisition Officer cum Competent Authority Saran at Chapra. (iii) For any other appropriate relief/reliefs to the petitioner is found entitled in the facts and circumstances of this case including cost of litigation with interest of compensation as per law."

3. At the outset, learned counsel for the petitioners submit that treating his land to be agricultural, award was prepared and eighty percent of the amount has been paid to him which he accepted under protest.

4. A counter-affidavit has come on behalf of the respondent nos. 3 and 4 and Mr. Vivekanand Singh, learned State counsel has taken this Court to the different paragraphs/photographs to show that the six men committee constituted by the District Magistrate, Saran found the land to be Agricultural.

5. At this stage, learned counsel for the petitioners submit that they shall be approaching the Arbitrator-cumDivisional Commissioner, Saran at Chapra for the redressal of the grievance.

6. Granting said liberty and without commenting on the merit of the case, the writ petition stands disposed of.

7. It is expected that the matter shall be taken to its logical conclusion at an earliest.
